4 arrested after scuffle involving police officers outside Fire & Ice Hookah Bar

MANCHESTER, NH – Four people were arrested early Monday morning following a scuffle outside Fire and Ice Hookah Lounge on Elm Street.

Officer Michael Roscoe was patrolling Elm Street near Fire and Ice Hookah Lounge, 990 Elm St., on March 13 at approximately 1:30 a.m. when he observed security personnel escorting a female from the business. A second female followed and they walked toward a vehicle parked on Elm Street, in front of the lounge.

The officer advised the two women to vacate the area as they began arguing with one another near their vehicle. A group of six to eight patrons abruptly exited the lounge and headed toward the two women he had previously spoken with. A woman who exited the bar began assaulting one of the other women. Officer Roscoe attempted to break up the fight while a crowd of patrons surrounded him.

The woman was later identified as Magdalena Oquendo Marquez, 40, of Lowell, Mass. She struck the officer with her hand as he grabbed hold of her and hit him in the face as the crowd pushed them away from the scene. Both he and Oquendo Marquez fell to the ground.

Officer Roscoe picked her up as a man grabbed her by the arm in an attempt to pull her away from the arresting officer. Officer Roscoe told the man several times to vacate the area, but he refused. Instead, he interfered with the arresting officer as he attempted to place Oquendo Marquez into custody. The man continued grabbing hold of her arm to pull her away from the officer. Officer Roscoe took hold of the man’s arm and advised him that he, too, was under arrest. The man pulled away then “squared up” with the officer, so the officer took him to the ground and attempted to handcuff him. The man, later identified as Miguel Fernandez, 31 of Lawrence, Mass., continued to be noncompliant while tucking his hands underneath his body. Officer Robert Megowen arrived on scene and utilized the stun option on his taser. Fernandez was placed into custody as multiple people gathered around them. Oquendo Marquez fled as the officers struggled with Fernandez. She was apprehended a short time later on Mechanic Street  by Officer Robert Bifsha.

Officer Alexander Martens arrived on scene and saw the two officers surrounded by a group of 10 people as they placed Fernandez into custody. One of the individuals, Jorman Perez Oquendo, 23, of Lowell, Mass., refused to back away from the officers even though Officer Martens ordered him to do so. After several warnings, Officer Martens told Jorman that he would be arrested. Jorman pulled away from the officer, so he was transitioned to the ground. Jorman remained noncompliant on the ground, but was eventually placed into custody.

The officers were waiting for the transport wagon to arrive when multiple people remained in the area. The patrons had spilled out of the lounge and were acting disorderly. One of the individuals, Alyssia Savage, 19, of Nashua, continued yelling profanities at the officers, so she too was taken into custody and charged with disorderly conduct.

  • Fernandez was charged with simple assault (on a police officer), hindering apprehension, disorderly conduct and resisting arrest/detention. Both Oquendo Marquez and Fernandez will appear in the 9th Circuit Court-Manchester on March 13, 2017.
  • Oquendo Marquez was charged with disorderly conduct, resisting arrest/detention and simple assault (on a police officer).
  • Savage was charged with disorderly conduct and released on $500 personal recognizance bail. She is scheduled to appear in the 9th Circuit Court-Manchester on April 18, 2017.
  • Perez Oquendo was charged with disorderly conduct and resisting arrest/detention and released on $1,000 personal recognizance. He is also scheduled to appear in the 9th Circuit Court-Manchester on April 18, 2017.
