Pot deal gone wrong leads to fight at mall, weapon charge

MANCHESTER, NH — An altercation at the Mall of New Hampshire resulted in two arrests on November 14, 2016. Officers were called to the area of Old Navy for an fight involving two men, one of whom was armed with a handgun.

Officers located Justin Choice, 22, of Boston inside  Gamestop. Choice allegedly sold marijuana to a another man, Garrett Clay, 20, of Derry,  the previous day and never received payment, so a confrontation ensued when Choice observed Clay at the man at the mall.

Choice told police that Clay allegedly walked toward him and pointed a gun at him. The officers were unable to substantiate his claim so Clay was not charged with criminal threatening.

Police officers located Clay near Old Navy and spoke with him about the alleged threat and confrontation. Clay stated he was armed with a handgun but denied threatening Choice with it during the confrontation. He too spoke about the incident stating it had to do with the purchase of marijuana the day before. Clay told the officers he refused to pay for the marijuana, so Choice recognized him at the Mall and allegedly attacked him. According to Clay, Choice allegedly struck him several times with his fist. Clay was in possession of a .380 handgun, but did not have a concealed carry permit. The handgun was placed into evidence for safekeeping.

The officers charged Choice with three counts simple assault and conspiracy to commit sales of a controlled drug. He was released on $1,000 cash/surety and is scheduled to appear in the 9th Circuit Court-Manchester on December 20, 2016

Clay was charged with conspiracy to commit possession of a controlled drug and carrying a firearm without a license. He was released on $1,000 cash/surety and is scheduled to appear in the 9th Circuit Court-Manchester on November 30, 2016.
